Digital Payment Platforms: Developments, Issues and Prospects

Session abstract:

Economies around the world are striving to become cashless. The pandemic has spurred the use of digital payment alternatives exponentially for a variety of transactions and services, thereby promoting financial inclusion of people previously without access to traditional banking services, bringing businesses, products and services to a broader base of customers, and more.

  • Policing the Platforms
    How and to what extent are the providers of all sizes of innovative e-payment solutions regulated in selected jurisdictions around the world?
  • Consumer Protection
    How are end-users and their interests protected (e.g., data protection)?
  • Safeguards
    How are abuses or misuses of such systems thwarted (e.g., antitrust regulations, big data regulations, anti-fraud measures, etc.)?

The panel will address these questions/topics and more in light of the regulatory challenges inherent in the borderless nature of digital payments and other fintech services, and the interests of multiple stakeholders in these evolving digital ecosystems.

Miriam Rose Ivan L. Pereira

Miriam is a registered foreign lawyer in Japan licensed in both the Philippines and the State of New York. Since joining Oh-Ebashi in 2008, she has been involved in multiple transactions in Asia, the U.S. and Europe. She regularly deals with contractual, intellectual property, antitrust, fintech, banking and other regulatory issues in cross-border transactions, investments and dispute resolution mainly involving Japanese companies. Together with local lawyers, she also supports foreign companies in investing and doing business in Japan.

Miriam is also actively involved in educational activities. She co-chaired the diversity-themed global conference of the International Section of the New York State Bar Association (“NYSBA”) in Tokyo in 2019, and is on the advisory board of an advocacy forum called Change Makers Japan. She writes and speaks about cross-border transactions, international dispute resolution, Philippine law and compliance matters. She also organizes talks on topics concerning international arbitration and mediation.

Apart from NYSBA, she is a member of several organizations, including the Women in Business Committee of the American Chamber of Commerce in Japan, Women Business Lawyers Committee of the Inter-Pacific Bar Association, and ArbitralWomen.

JJ is one of the leading information and technology law experts in the Philippines today. His areas of expertise are litigation, intellectual property, licensing, privacy and data security, copyright, trademark registrations and technology transactions. He has represented local and foreign clients in corporate, project finance, securities, foreign investment, technology, and telecommunications, among others. He holds a master’s degree in law from Harvard Law School. He is also the first lawyer member of the Philippine Internet Commerce Society (PICS) and was actively involved in lobbying for the passage of the eCommerce Act. He drafted its implementing rules in 2000. A year later, he co-drafted the Rules on Electronic Evidence as part of the Supreme Court’s eCommerce Sub-committee. He is a professor of the University of the Philippines College of Law and is a professional lecturer at the Philippine Judicial Academy.
